These Terms of Service ("Terms") govern your access to and use of Hot Boards, the broadcast spotter-board application available at hotboards.tv (the "Service"), operated by Archuleta Entertainment LLC ("Hot Boards," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Hot Boards is a tool for broadcasters, announcers, and production staff to organize NFL roster, depth-chart, statistical, and reference information for game-day preparation and on-air use. The Service is currently offered as a beta and may change, be interrupted, or be discontinued at any time.
You must create an account to use the Service. You agree to provide accurate information, keep your sign-in credentials secure, and accept responsibility for all activity under your account. You must be at least 18 years old, or the age of majority where you live, to use the Service.
You agree not to:
Roster, depth-chart, statistical, and biographical information in the Service is compiled from third-party sources and is provided on an "as is" and "as available" basis. While we strive for accuracy, we do not warrant that this information is complete, current, or error-free. You are solely responsible for any decisions, broadcasts, or statements you make using the Service. Hot Boards is not affiliated with, endorsed by, or sponsored by the National Football League, any team, or any data provider.
Boards, notes, and other materials you create ("Your Content") remain yours. You grant us a limited license to store, process, and display Your Content solely to operate and provide the Service to you. You are responsible for Your Content and for keeping your own backups where appropriate.
The Service is provided during an ongoing development and beta period. Features may change or be removed, and availability is not guaranteed. We are not liable for any loss resulting from downtime, data loss, or changes to the Service.
The Service — including its software, design, branding, and the "Hot Boards" name and logo — is owned by Archuleta Entertainment LLC and protected by applicable law. These Terms grant you no rights in our intellectual property except the limited right to use the Service.
Hot Boards offers two ways to pay: a one-time Single Game purchase that unlocks one matchup, and a Season Pass for a given sport (NFL, College Football, or FCS) that unlocks every matchup in that sport's regular season. Current pricing is shown in the app before you pay.
A Season Pass is paid in a fixed number of monthly installments (the number of payments and their amounts are shown before you buy). You get full access to the season pass immediately, on your first payment — the installment schedule is how the price is billed, not a limit on your access. If a scheduled installment payment fails and cannot be collected after retry, your access to that season pass may be revoked. A Season Pass does not renew and does not carry over to a future season; buying it again next season is a separate purchase.
Payments are processed by Stripe; we do not store your card details. Refunds are handled case by case — contact support@hotboards.tv.
We may suspend or terminate your access to the Service at any time for any violation of these Terms or to protect the Service or other users. You may stop using the Service at any time and may request deletion of your account by contacting us.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW.
TO THE FULLEST EXTENT PERMITTED BY LAW, ARCHULETA ENTERTAINMENT LLC AND ITS OWNERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $100.
We may update these Terms from time to time. We will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws rules. Any dispute arising under these Terms will be subject to the exclusive jurisdiction of the state and federal courts located in Arizona.
